User Terms

These User Terms explain the terms that apply when you use EnrichMyCare digital services. Please read them together with our Privacy Notice. Different provisions apply depending on whether you use EnrichMyCare as a parent or carer, as an authorised healthcare professional, or through a school.

Part 1

General Terms

This Part applies to everyone who uses EnrichMyCare. Depending on how you use EnrichMyCare, one or more of Part A (Parent/Carer & Family), Part B (Professional/Clinician) and Part C (School-Linked Pathway) also apply to you, in addition to this Part. Where anything in Part A, B or C is inconsistent with this Part, the more specific wording in that Part applies.

1. Who We Are and What These Terms Cover

“EnrichMyCare Services” means the Family & Child app, the Professional/Clinician dashboard, the School-Linked referral portal, and any related applications, dashboards, AI-assisted tools and support services we provide, whether accessed by a parent or carer, a clinician or other professional, or a school. It does not include the public EnrichMyCare corporate website, which is governed by our separate Website Terms of Use, or a Managed Clinical Pathway Transformation engagement with an NHS organisation, which is governed by a separate Master Services Terms and Statement of Work.

5. Content You Provide

You retain any rights that you or the organisation you represent have in Content submitted to EnrichMyCare. You must only submit Content that you are authorised to provide.

Where EnrichMyCare processes Content on behalf of an NHS organisation, school or other organisation, its use of that Content is governed by the applicable Organisational Agreement and data protection arrangements, not by this Section.

Where you use the Independent Family Service, you give EnrichMyCare the rights reasonably necessary to host, store, display and process Content for the purposes of providing the service, in accordance with these Terms and our Privacy Notice. We do not use your Content to train third-party AI models, and we do not sell it or use it for advertising.

6. How AI Is Used Within EnrichMyCare Services

Within organisation-linked clinical pathways, AI-assisted tools may help authorised healthcare professionals review and organise information, prepare clinical summaries, and support aspects of clinical triage. These tools support healthcare professionals; they do not make decisions about a child’s care on their own, and an authorised healthcare professional reviews AI-assisted output before it is used in clinical decision-making.

These tools are only available to authorised professionals within an organisation-linked clinical pathway. They are not available to users of the Independent Family Service or to school staff.

EnrichMyCare may also use information about a child to provide personalised information and resources as part of their care pathway. These operate under appropriate clinical governance arrangements and do not replace assessment or advice from a child’s healthcare team.

7. Safeguarding and Emergencies

EnrichMyCare Services are not for use in an emergency.

If you believe your child is in immediate danger or needs urgent medical attention, call 999 or go to your nearest A&E. If you are worried about your child’s wellbeing but it is not an emergency, contact your GP, your child’s care team, or your local social services.

EnrichMyCare does not replace the safeguarding responsibilities or procedures of the organisations using the service. Safeguarding concerns identified in connection with a child’s care remain the responsibility of the relevant clinical or education team and are handled in accordance with that organisation’s safeguarding procedures.

8. Availability and Changes to the Service

We aim to keep EnrichMyCare Services available and to give reasonable notice of planned maintenance, but we do not guarantee uninterrupted access. We may change or discontinue a feature of EnrichMyCare Services, and we will give reasonable notice of any change that materially affects how you use it.

10. Intellectual Property

EnrichMyCare Services, including our software, technology, methodologies, designs, documentation and related intellectual property, belong to Enrich Digital Technologies Ltd or its licensors. We give you a personal, non-exclusive, non-transferable right to use EnrichMyCare Services in line with these Terms. You get no other rights in our intellectual property. Detailed provisions covering EnrichMyCare’s Clinical Pathway Transformation Methodology and related intellectual property, where relevant to a specific NHS engagement, are set out in the applicable Master Services Terms rather than these Terms.

11. Our Responsibility to You

We will provide EnrichMyCare Services with reasonable skill and care. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you use the Independent Family Service as a consumer, your statutory rights are not affected. We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We do not warrant that any AI-assisted tool will be free from error; its output is an aid to, and always subject to review by, a qualified professional. For professional and school-linked users, the commercial liability arrangements between EnrichMyCare and your organisation are governed by the applicable Organisational Agreement; these User Terms do not make you personally responsible for your organisation’s commercial liabilities.

12. Complaints and Feedback

If something isn’t working as it should, or you want to raise a complaint, contact [email protected] and we will respond as quickly as we can. If you give us feedback or suggestions, we may use them to improve EnrichMyCare Services, but you keep any rights you have in your feedback.

13. Changes to These Terms

We may update these Terms from time to time. We will give reasonable notice of material changes. Where a change materially affects your rights or obligations under the Independent Family Service, we may ask you to accept the updated Terms before continuing to use the affected service, rather than relying on continued use alone.

Parent/Carer & Family Terms

This Part applies in addition to Part 1 when you use the Independent Family Service, and continues to apply to the parts of your account that remain within the Independent Family Service even after Linking, as described in our Privacy Notice.

A1. Creating a Family Account

You must have parental responsibility for a child to create a profile for them. You can record diaries, questionnaire responses, media and other information about your child.

Inviting education staff. Within the Independent Family Service, you can invite an education staff member to create their own account, which they can then use to log in and view or contribute information through the access provided following your invitation. This is separate from the School-Linked Pathway described in Part 1 and our Privacy Notice, which is arranged by a school itself.

Sharing an individual record. Separately, you can choose to share a specific record you consider helpful with a healthcare professional, social care professional, carer, respite worker, or another agency. The recipient accesses only the specific record you share through EnrichMyCare’s secure, verified sharing process. This is different from inviting education staff, and different from Linking your account to an NHS-Linked Pathway (see A3): the recipient does not receive an ongoing account, a clinician dashboard, or access to the AI-assisted tools described in Part 1, Section 6.

Accuracy of information you provide. You must take reasonable care to make sure the information you record about your child — including diaries, questionnaire responses and any information you share — is accurate and complete to the best of your knowledge, since it may be used to support decisions about your child’s care.

A2. Fees

The Independent Family Service is currently provided free of charge. If we introduce an optional paid feature in the future, we will show its price and any additional terms that apply before you purchase it.

A3. Linking Your Account to an NHS Pathway

Section 5 of our Privacy Notice explains what happens when you choose to link your Independent Family Service account to an NHS organisation, including that your authorisation to share information is separate from, and does not replace, the NHS organisation’s own legal basis for its subsequent processing. The same principles apply under these Terms: Linking does not change the status of your whole account, and you can continue to use the Independent Family Service for your own purposes for information you have not chosen to share.

A4. What You Can and Cannot Do

As a user of the Independent Family Service, you cannot access or run the clinician-facing AI tools described in Part 1, Section 6. Personalised information and resources may be available to you where they form part of an organisation-linked care pathway, as described in Part 1, Section 6. Administrative processes that support referral handling are not features of the Independent Family Service.

Neither inviting education staff nor sharing an individual record gives the recipient clinician-dashboard access or access to the clinician-facing AI tools described in Part 1, Section 6. Access to those tools is provisioned by EnrichMyCare only for organisation-linked professional users, following an NHS or healthcare organisation’s own arrangement with EnrichMyCare — a parent cannot provision this access, and a person’s professional title alone does not create it.

A5. Ending Your Family Account

You can close your Independent Family Service account at any time. Where the right to erasure applies, information held in the live Independent Family Service will normally be deleted within 30 days, subject to the limited retention described in our Privacy Notice and the short period during which deleted information may remain in secure system backups. Closing your account does not automatically delete information that has already been shared with an NHS organisation or school and is being retained by that organisation for care, safeguarding, legal or records-management purposes.

Part B

Professional/Clinician Terms

This Part applies in addition to Part 1 if you access EnrichMyCare Services as a clinician, therapist or other professional, on behalf of an NHS organisation or other employer.

B1. Two Layers of Agreement

Your organisation has its own Organisational Agreement with EnrichMyCare governing its use of the EnrichMyCare Services. This may include a Master Services Terms, a Statement of Work, a Data Processing Agreement, and relevant service, information-governance or clinical-safety schedules. The Organisational Agreement governs the relationship between EnrichMyCare and your organisation, including commercial terms, data protection obligations and liability — it is not replaced or narrowed by this Part.

In addition, when you first log in, you are asked to accept the Professional User Conditions set out below. These cover matters that apply to you personally as an individual user. You are not asked to personally accept your organisation’s commercial terms, Data Processing Agreement or liability arrangements — those remain your organisation’s responsibility.

Your access to EnrichMyCare Services as a professional user ends when your organisation’s Organisational Agreement with EnrichMyCare ends, or when your organisation tells us your access should be removed — for example, when you leave your role.

School-Linked Pathway Terms

This Part applies in addition to Part 1 if you access EnrichMyCare Services as a SENCO or teaching staff member, under an agreement between your school and EnrichMyCare.

C1. Two Layers of Agreement

Your school has an agreement or other approved data-sharing arrangement with EnrichMyCare (“Organisational Agreement”), which governs the relationship between EnrichMyCare and your school, including data protection obligations.

In addition, when you first log in, you are asked to accept the Professional User Conditions set out below. These cover matters that apply to you personally as an individual user. You are not asked to personally accept your school’s own data protection obligations — those remain your school’s responsibility.
